- Force majeure events
7. Revisions
Projects generally include a mutually agreed number of revision rounds.
Requests that substantially change the original project scope may be treated as additional work and billed separately.
8. Intellectual Property
Unless otherwise agreed in writing:
- The client retains ownership of content, trademarks, logos, and materials supplied by them.
- Kiren Smart Services retains ownership of proprietary tools, frameworks, methodologies, templates, source libraries, and reusable development components.
- Ownership of final deliverables transfers to the client only after full payment has been received.
The Company reserves the right to showcase completed work in its portfolio, website, presentations, or marketing materials unless a written confidentiality agreement states otherwise.
9. Third-Party Services
Projects may involve third-party products or services, including:
- Hosting providers
- Domain registrars

The Company is not responsible for outages, policy changes, pricing changes, discontinued services, or performance issues arising from third-party providers.
10. Website Maintenance
Unless covered under a maintenance agreement, ongoing support, updates, backups, security monitoring, bug fixes, and content changes are not included after project completion.
Maintenance services are provided under separate service plans where applicable.

While we use industry best practices to improve online visibility and marketing performance, we do not guarantee:
- Specific search engine rankings
- Lead volume
- Sales
- Website traffic
- Advertising performance
- Social media growth
Results depend on multiple external factors beyond our control.
12. Limitation of Liability
To the maximum extent permitted by law, Kiren Smart Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Website downtime
- Data loss
- Business interruption
- Lost profits
- Security breaches caused by third-party systems
- Client misuse of delivered work
- Delays beyond our reasonable control
Our total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.
13. Confidentiality
Both parties agree to maintain the confidentiality of proprietary business information shared during the course of a project.
Confidential information will not be disclosed to third parties except where required by law or necessary for project execution.
14. Cancellation and Termination
Either party may terminate a project by providing written notice.
In such cases:
- Payment is required for all work completed up to the termination date.
- Advance payments may be non-refundable once work has commenced.
- Deliverables completed before termination will be provided upon settlement of outstanding payments.
15. Website Availability
We strive to keep our website operational at all times. However, we do not guarantee uninterrupted availability and reserve the right to modify, suspend, or discontinue any part of the website without prior notice.
